I'm not sure if Nintendo can really do sth against using the Wiimote on a PC unless you use this for marketing.

The PC drivers usually do not involve any code or anything else from Nintendo. It's a "simple" Bluetooth device driver. So I doubt a PC driver itself is illegal.
