what would be the deal if i was to recreate a classic from the 80s for commercial use?

hi,

depends on who owns the rights now. Without written permission I would not use original assets.

An similar clone leads to problems. See the Giana Sisters/ Mario Bros. Story. Maybe a parody is possible.

Check dictionary for parody.

Company does not need to exist, someone may still be holding rights for the IP.

Just don't use original artwork (or one that looks highly similar) or characters from the classic game and obviously not its name and you are fine.
