As much as i agree with your pov on the fan game subject (granted when i first started game programming, i made a complete mario bro 3 remake that i was super proud of anyways....) I dont think this article will work for what you intend it to because every person is going to shout "look it says
Quote:
PC adventure title Limbo Of The Lost, by Majestic Studios - a real, commercial title

and mines not commercial so shove off!"

I think in order to prove our point we need to find an example of a non profit seeking project getting a real cease and desist.

Edit: I just read farther into it and googled the situation, i found this:

holy crap you have to have nice size cohones to try and pull of such a blatant copy. Amazing the stupidity, lack of creativity, and overall laziness of some people

heh, Limbo Of The Lost(LOL for short) is a epic fail. Man, they ripped everything from other games. Slient Hill,WoW,Thief,Diablo,Oblivion,Unreal Series,Painkiller,Vampire:TMSB and lots of other games. And it's just a 2d point and click game, all they did was usin the "Print Screen" key.

some believes it is a joke and you cant really buy it. And this game, LOL , is not standing as a Fan-Game. It is just a <place some word here, i dont know what to say.>

PS: They claim it took 10 years to make the LOL.

And my rebuttal is that it doesn't matter if it's commercial or not... using other peoples work without permission IS rippping off and I have a strong belief that the reaction from companies and community would have been no different if LOL was freeware. Unfortunately, the belief that only commercial games are illegal is made worse by the fact that only commercial targets (being highly visible) are more likely to get prosecuted giving the IMPRESSION that free fan games are okay

I know this isn't a perfect example of the "fan art" POV, but the fact that you are using other peoples work without permission is what's wrong and the main point; the fact that they are asking money for it is just ballsy!

Funniest damn news I have read in weeks...

Majestic can go crawl under the rock they came from. Talk about clueless....

Tri Synergy is not a publisher, they are a placement house. You pay them to get your product on the retail shelf. This is useful if you have a legit product, but embrassing if you have a illegit product like LIMBO.... I hope Tri Synergy suffers a little on this, they need to do a little more homework before they collect the placement check....

If this does not mortally wound the adventure genre on PC's I do'nt know what will....

Did LIMBO get an ERSB on this, you would think ERSB would have caught the ripped off scenes also....

@Fastlane this is the opposite of "Fan ware". smile Still helps support your position. Leave other peoples IP's alone. Regardless of intent.

Ken

It even stole from Enter The Matrix (or maybe The Path of Neo don't quite remember) (there's a sewer level that looks like a complete clone).

Pretty wicked stuff, but they already pulled all the games from the shelves... I'm pretty sure business is over for not-so Majestic Studios...

I could be way off as I don't really know, but as far as I know the ESRB doesn't check copyright infringements..

Hilariously bad trailer here: http://www.gametrailers.com/player/34863.html

I guess they did what the trailer punchline is; 'Forget Reality, Surrender to your darkest dreams.' LOL.
