I guess this question may be noobish, but i wonder, if i want to include songs by famous groups, singers, etc in my game, should i ask their or label's permission to do that? Is it illegal to do that without asking the permission?

You need to have permission and pay fees, if the artist is registred in a performance rights organization.

Or: use Creative Commons music or you ask musicians - that are not registred in such an organization - if they agree that you use their song.

also dont forget to get a contract for either form of music. musicans tend to charge a lot of money for their work. dont rely on some spoken, written word "you can use it" - get a contract where that both of you sign.

It would probably be too expensive for you to license a song. On top of that, just because you may have the funds doesn't mean you'll get the rights. Many bands will have to approve of the product before they allow use of their IP.

Another alternative is to use public domain or royalty free music. There are many websites that off these kinds of tracks, and there are fully orchestrated pieces of music for a nominal cost. I plan on using famous classical music in my own (although sparingly), and I have scoped out a few sites that have quality versions of what I'm after.

the best thing you can do is searching a band or musician without a label contract or something.
if you need gothic, metal, punk or industrial, sign up @ vampirefreaks.com and browse some bands. most of them are very helpful. we (for example) now have 3 bands that allow us to use their music. if you have no problems with a gothic forum, have a try!

Thank you, now i get it...labels suck
I guess in my case the best way is to include mp3/ogg player into the game, so the player will choose the sountrack himself

Keep in mind that using mp3 in a commercial is illegal if you don't pay the licensing fees.
